Welcome to Consight ("we," "us," or "our"). By accessing or using our software-as-a-service platform (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Consight provides a cloud-based software solution for construction project management, including but not limited to bid leveling, budgeting, scheduling, and document management.

3. User Accounts

3.1. You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account and password.

3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4. Subscription and Payments

4.1. The Service is provided on a subscription basis. You agree to pay all fees associated with your chosen subscription plan.

4.2. Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan.

4.3. All fees are non-refundable except as expressly provided in these Terms.

5. User Content

5.1. You retain all rights to any content you upload, post, or share through the Service ("User Content").

5.2. By uploading User Content, you grant Consight a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content solely for the purpose of providing and improving the Service.

6. Acceptable Use

6.1. Use the Service for any illegal purpose or in violation of any local, state, national, or international law.

6.2. Violate or encourage others to violate the rights of third parties, including intellectual property rights.

6.3. Attempt to gain unauthorized access to the Service or its related systems or networks.

6.4. Transmit any viruses, malware, or other types of malicious code.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Consight and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

9. Limitation of Liability

In no event shall Consight, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of California, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on this page.
